CALL TO ORDER

Chair Tan called the meeting to order at 5:35PM.

Director, Jocelyn Kane called the Roll.

Present at the meeting were Commissioners, Bryant Tan, Al Perez, Steven Lee, Audrey Joseph, Liam Frost, Dori Caminong and Demetri Moshoyannis.

Commissioner Perez absent at time of roll call.

2. Review and approve the minutes of August 18, 2015 & September 15, 2015 [Action item]

COMPLAINTS
9/27/15 5:30 PM El Amigo 3355 Mission St.
Report of a DJ on Sunday. Venue not permitted. Will be following up with establishment and complainant.
9/29/15 8:30 AM Unknown Venue 311 Complaint
“Some sort of concert event at a building on Franklin and Ivy is very loud and the caller can hear very poorly executed music even with his windows closed at a very loud volume” - will be following up with complainant for additional information.

10/4/15 9:00 PM Balancoire 2565 Mission St.
“Club leaving doors open and music can be heard in my apartment with all my windows closed/shut tight. There is inadequate sound proofing and staff. Additionally, on more than several occasions, the night club does not do control the crowd that get out from the club which disturb the entire neighborhood at 2am+ with boom cars and loud screaming and laughing.” – Currently investigating complaint and will follow up.

SOUND INSPECTIONS
9/25/15 10:55 PM AC/DC @ AT&T Park 24 Willie Mays Plaza – Audible in Dogpatch, Potrero Hill, and Bernal Heights neighborhoods. Show ended within approved time on permit. Still awaiting complaints from hotline and information from sound consultant hired by Giants.

10/4/15 12:30 PM Castro Street Fair 3 Stages along 18th and Castro Streets
No complaints. All stages’ volumes kept at a reasonable level in line with City code.

SITE INSPECTIONS
9/19/15 10:30 PM 26 Mix 3024 Mission St.
Complaint regarding metal stantion blocking sidewalk. In compliance with SF Better Streets guidelines outlined at http://www.sfbetterstreets.org/design-guidelines/sidewalk-zones/

9/19/15 11:45 PM Toad Hall 4146 18th St.
Permit unavailable at time of inspection. All else in compliance. Will be following up regarding permit.
Inspector Pauley - Notes for EC meeting 10/6/15
INSPECTIONS:
10/4/2015 1:30 AM The Cellar 685 Sutter St.: A walkthrough inspection was performed. The venue was in compliance.
10/4/2015 12:00 AM City Nights 715 Harrison St.: A walkthrough inspection was performed. The venue was in compliance.

10/3/2015 11:00 PM F8 1192 Folsom St.: A minor scuffle was observed after a random assailant vandalized a vehicle outside of the venue. Security could not apprehend the vandal. Security stated that they did not understand why the assailant vandalized the vehicle.

COMPLAINT:
9/27/2015 1:15 AM Tunnel Top 601 Bush St.: A complaint was received in regards to the Tunnel Top Lounge. Venue is now officially under new ownership. The venue was out of compliance. The new ownership was appraised of the issue and has since committed to eliminating the problem.

COMPLIANCE:
10/3/2015 10:45 PM The Box SF 1069 Howard St.: The venue was concerned about a noise complaint generated by a neighbor. In my limited observance of the venue on that night, the venue was in compliance.

SOUND TEST:
10/3/2015 10:45 PM VERSO 1025 Mission St.: A set of sound tests were conducted in support of the venues permit application (see memo).

4. Police Department Comments & Questions. [Discussion Item]
(This item allows any member of the SFPD to address the Commission regarding matters related to nightlife and public safety).

No comments were made.

5. Hearing and Possible Action regarding applications for permits under the jurisdiction of the Entertainment Commission. [Action item]

a) EC-1348 – Scherer, Jeremy, Verso, 1525 Mission Street, Place of Entertainment Permit.

Commissioner Joseph recused herself from the item.

Public comment

Ken P. stated he was resident to the neighborhood for the past 20 years. He added there have been problems with the space in the past with sound and requested the commission keep the past conditions with the space for the new applicant and to put a limit on the sound.

Matt Small a neighbor next to the building. He added no space has been successful mitigating the neighborhood impact with sound and the previous venue was never able to be in compliance. He added they should have strict limits of hours of operation.

Kathryn Norris a resident that lives adjacent to the space. She added they experience a lot of noise with the previous venue Sloan. She added they worked with Sloan to mitigate the sound but it never worked. She asked the Commission to work with the residence with the impacts of sound and noise transmission.

Joe Pero stated Sloan was out of control for a while, so far Plump Jack has been ok, but had to call the venue regarding the sound. He hoped the new business would not create more problems.

Charles Salter with Salter & Associates stated sound they measured the venue three years ago and last Friday night. He added the noise decibel was 10-15 decibels lower because Plumb Jack built a new wall and has reduced the noise transfer. He added they were not claiming victor and there still may need to be adjustments in the audio system and it was adjustable.

6. Report from the Residential Development Review Committee
The Committee is a 3-member group that meets before the Regular Entertainment Commission meeting to review residential projects per Admin Code 116 and make recommendations. [Action item]

Director Kane stated there was one project located at 363 6th street and there was a short presentation from the project sponsor. She added the Commission expressed their concerns and set their regular set of conditions that are on the Entertainment Commissions website.

7. Commissioner Comments & Questions. [Discussion item]

Commissioner Moshoyannis stated he would
be resigning from the Commission since he was
moving to the east bay he will not meet the
requirements to serve on the Commission due
to other life decisions that came up with raising
a child and commuting to the East Bay.

Stefano Casalato stated Commissioner
Moshoyannis was a great addition to the
Commission and will be missed.

8. New Business Request for Future Agenda Items. [Action item] (This item is to allow Commissioners to introduce agenda items for future consideration).
